TERMS AND CONDITIONS OF SALE

ARTICLE 1: SUBJECT These Terms and Conditions of Sale (TCS) govern the contractual relationship between the website SongTailor (hereinafter referred to as "the Seller") and any natural or legal person wishing to make a purchase on the website (hereinafter referred to as "the Buyer").

ARTICLE 2: PRODUCTS AND SERVICES SongTailor provides a service for creating custom-made songs upon request. The characteristics of the songs (style, lyrics, duration) are defined during the ordering process via the forms provided on the website.

ARTICLE 3: PRICING AND PAYMENT Prices are indicated in Australian Dollars (AU$) or Euros (€) including all taxes (TTC/GST). SongTailor reserves the right to modify its prices at any time. Payment is due immediately upon ordering via credit card or through the secure payment services offered on the website (Stripe/PayPal).

ARTICLE 4: DELIVERY The personalized song is delivered in digital format (MP3/WAV) via email to the address provided by the Buyer. Delivery times are provided as an estimate on the product page. SongTailor cannot be held responsible for delays caused by an error in the provided email address.

ARTICLE 5: NO RIGHT OF WITHDRAWAL (IMPORTANT) In accordance with consumer protection laws regarding the supply of goods made to the consumer's specifications or clearly personalized, the right of withdrawal (cooling-off period) does not apply. Consequently, the Buyer expressly acknowledges that once the order is validated and the production of the song has commenced, no right of withdrawal, return, or refund will be accepted.

ARTICLE 6: INTELLECTUAL PROPERTY The purchase of a song grants the Buyer the right to use it for personal and private purposes only. Any commercial use, public broadcasting, or resale of the song without prior written agreement from SongTailor is strictly prohibited. SongTailor retains the copyright to the musical composition.

ARTICLE 7: LIABILITY SongTailor strives to best meet the Buyer’s instructions. However, as artistic appreciation is subjective, no refund requests will be accepted based on simple aesthetic disagreement.

ARTICLE 8: GOVERNING LAW These Terms and Conditions are governed by French law (or the laws of the operating jurisdiction). In the event of a dispute, an amicable solution will be sought before any legal action is taken before the competent courts.
